These Terms of Service ("Terms") govern your access to and use of Pushly, a Software-as-a-Service platform designed for automated video publishing and agency management. By accessing or using our platform, you agree to be bound by these Terms.
Pushly provides a suite of tools that allows content agencies, creators, and community managers to organize, process, and automatically publish video content across multiple third-party social media platforms, including but not limited to YouTube Shorts, TikTok, and Instagram Reels.
Our platform relies entirely on official APIs provided by third-party social networks. By utilizing our service to publish content to these networks, you explicitly agree to adhere to their respective Terms of Service and Community Guidelines:
We are not responsible for any changes in third-party API policies, rate limits, or availability that may affect the functionality of Pushly.
You are solely responsible for all media, captions, hashtags, and content you upload, schedule, and publish through Pushly.
To the maximum extent permitted by law, Pushly shall not be liable for any direct, indirect, incidental, or consequential damages resulting from your use of the platform.
Account Penalties: Pushly is not liable for any actions taken by third-party platforms against your social media accounts. This includes, but is not limited to, content takedowns, shadowbans, temporary suspensions, or permanent account bans resulting from the content you choose to publish via our API integration.
You are responsible for maintaining the confidentiality of your account access, including your organizational Master PIN. You are responsible for all activities that occur under your agency's environment. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
The Pushly platform is provided on an "AS IS" and "AS AVAILABLE" basis. While we strive for maximum uptime and reliability, we do not warrant that the service will be uninterrupted, timely, secure, or error-free. Delays in scheduled publishing may occur due to external server loads (e.g., GitHub Actions, QStash) or third-party API outages.
We reserve the right to modify or replace these Terms at any time. Material changes will be communicated through the platform. Your continued use of Pushly following the posting of any changes to the Terms constitutes acceptance of those changes.
We may terminate or suspend your access to Pushly immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms or utilize the platform for malicious activities.
